Please read these Terms and Conditions carefully before using our logistics services.

Welcome to Modena Cargo Services LLC (“Modena”, “we”, “our”, or the “Company”). By requesting a quotation, engaging our services, or using our website, you agree to be bound by these Terms and Conditions. These terms govern the relationship between the client (“Client”, “you”) and the Company, headquartered in in Dubai, United Arab Emirates.

1. Scope of Services

Modena provides logistics, freight forwarding, customs clearance, and warehousing services. All transit times are estimates only and may be affected by circumstances beyond the Company’s control, including weather conditions, port congestion, carrier delays, customs inspections, or force majeure events.

2. Client Obligations

The Client agrees to:

  • Provide accurate, complete, and truthful shipment information (nature, quantity, weight, value, and contents).
  • Ensure goods are properly packed, secured, and labeled unless packing services are provided by the Company.
  • Supply all required customs documentation in a timely manner.

The Client is fully responsible for any loss, delay, penalty, or additional cost resulting from incorrect or incomplete information or documentation.

3. Prohibited and Restricted Items

The shipment must not contain prohibited or illegal goods, including but not limited to:

  • Illegal drugs or narcotics
  • Weapons, explosives, or unauthorized ammunition
  • Counterfeit or pirated goods
  • Hazardous or dangerous materials unless declared and approved in writing

The Company reserves the right to inspect, delay, refuse, or suspend shipments that violate laws or these Terms and Conditions.

4. Liability and Insurance

The Company’s liability for loss or damage is limited in accordance with applicable international conventions and standard freight forwarding practices, including the Hague-Visby Rules, Warsaw Convention, or Montreal Convention where applicable.

Insurance: Cargo insurance is not included unless expressly agreed in writing. Clients are strongly advised to obtain insurance for high-value shipments. The Company is not liable for indirect, incidental, or consequential losses such as loss of profit or business interruption.

5. Customs Duties and Taxes

The Client is solely responsible for all customs duties, taxes, fines, penalties, or charges imposed by authorities. Any payments advanced by the Company must be reimbursed immediately upon invoice.

6. Payment Terms

  • All invoices are due immediately unless otherwise agreed in writing.
  • The Company may exercise a lien over cargo for unpaid charges and may retain or dispose of goods according to applicable law until payment is received.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes shall be subject to the exclusive jurisdiction of the Dubai Courts.
